Managing compliance for Representative Offices (RO) in Vietnam entails additional responsibilities beyond basic compliance. It includes labor, immigration, personal income tax/social insurance for employees, regulatory requirements, and certain statutory reports required by various authorities.
From our data of the Department of Industry and Trade, as of the end of 2023, we realise that there are thousands of Representative Office of foreign traders in nationwide, specifically there are more than 3,000 in Ho Chi Minh City, of which, many of them have limited resources to take care of the compliance issues that are changed frequently.
This leads to a result that many Representative Offices have faced to administrative penalties imposed by the licensing authority due to late amendments, failure/late submissions or scope of operations are not complied with the prevailing regulations.
The key consideration is how the Representative Office can identify the impact from the prevailing legislations to handle them effectively.
